Privacy Notice and Security Information

Application and Consent

This Privacy Policy discloses the online privacy practices for CleanBrain Software, Inc. (aka CleanTelligent), a Utah corporation ("Company"), and applies to the information and data collected through our website at www.cleantelligent.com ("the Site"). Use of the words "we" and "our" refer to Company. Use of the words "you" and "your" refer to you. This Privacy Policy applies to our online and related practices as noted herein and not necessarily to other areas of Company. By accessing and/or using the Site, you are consenting to the collection, storage, disclosure and use of information and data, and to acceptance of the terms, conditions and practices, described in this Privacy Policy. Except for information and data submitted through the use of Company's subscription service software (the "Subscription Services") by our registered customers and their customers (the "Client Data"), you acknowledge that Company is the sole owner of the information and data collected on the Site.

Commitment to Privacy and Limitations

Your privacy is important to Company. Company recognizes the importance of protecting information and data we may collect from visitors and our customers to our Site. By collecting and utilizing certain information and data, Company is able to operate effectively and to provide better services in connection with the Site. We strive to put in place what we determine to be reasonable electronic and other procedures to help safeguard the information and data you provide to us from unauthorized access and unauthorized disclosure, subject to the terms and conditions of this Privacy Policy. However, no transmission, transfer or storage of information and data submitted or collected online can be completely secure. Accordingly, any access of, transmissions or submissions to, or provision of information or data to, the Site, are at your own risk. We do not ensure, and we make no warranty, guarantee or representation, that the access or use of the Site or the Software, Materials and Services (as defined below), information, data or content is protected from security threats, hacking, viruses, or other vulnerabilities, or that your information or data will always be secure. Ultimately, you are solely responsible for maintaining the security of your transmissions, submissions, information, data, user names and passwords. You should not disclose user names, passwords or other sensitive or personal information to others. You should sign out of your account and close your browser window when you finish each session to limit access by others. Please be careful and responsible whenever you are online.

If you use our Subscription Services, the confidentiality and limited use of Client Data by us will be governed by the agreement(s) entered into in order to use such Subscription Services in addition to that which is specifically mentioned in this Privacy Policy.

Collection and Use of General Information and Data

When you browse the Internet an internet protocol (IP) address is generally automatically assigned to your computer. When you request a page from the Site, our servers log your current IP address into our system. When you access the Site, we may collect and store general information and data relating to traffic patterns, Site usage, services utilized, searches, accounts, length of stay, location, devices, browsers, identifying numbers, routing, and other matters, including through cookies and other means. All of the above-described general information and data is referred to in this Privacy Policy as "General Information." Much of this General Information is not personally identifiable information. We may enter and store the General Information in our database. We may use the General Information to diagnose problems with our servers, to administer the Site, to improve our Site, services and goods, and for other purposes.

Cookies

Our Site generally uses "cookies" to collect, store and track information about you and how you use our Site. Collection and Use of Email Information and Data

When you communicate with us by email, we may collect your email address and related information and data. This type of email information and data is referred to in this Privacy Policy as "Email Information." Transmissions by email and other means are not secure. If you received email from us, (a) your email address is either listed with us as someone who has shared this address for the purpose of receiving information in the future, (b) your email address was input into the Subscription Service for the purpose of receiving emails from the Subscription Services, or (c) you have registered or purchased or otherwise have an existing relationship with us. We may collect this information and data in order to communicate with you, to respond to your inquiries, and for other purposes. We may enter and store the Email Information in our database. We may also use it in order to contact you, request further information and data, supply information and data, or for other purposes. We respect your time and attention by controlling the frequency of our emails. Emails sent from the Subscription Services are sent according to user preferences and the frequency is determined by such preferences. As emails are sent to you they may contain an automated way for you to cease receiving email from us, or to change your expressed interests. If you wish to do this, follow the instructions at the end of the email to the extent included and as applicable. We may also track which links you click on inside the email, if any.

Collection and Use of Information and Data Resulting from Use

Where applicable requirements are met, you may in some instances access the Site to register, login, view, use, execute and run certain programs including, but not limited to, the Subscription Services, program upgrades, documentation or information, or to view, use, download or acquire certain materials, services or goods, potentially including by way of example, certain instructional articles and materials, website posting and communication services, information, data, content, documents, items and materials posted on the Site by Company or others, question and answer forum services, document, video, and electronic library services, enhanced website services, and other optional, stand-alone, related and other services and goods as may be provided at the Site by Company, as of the present date or as updated, upgraded, modified, added or deleted by Company from time to time, all as determined by Company in its sole discretion, subject to the terms and conditions of our online and other agreement(s) with you, including any terms or use agreement, and other agreement(s) with you, as applicable in each case (all of the foregoing are hereinafter sometimes referred to as the "Software, Materials and Services" for purposes of this Privacy Policy). When you register or otherwise enter into such agreements with us, or you exercise some or all of the above-described rights, you may be required to provide certain information and data regarding yourself, your business, proposed transactions, and other matters, which we collect and store. This may include, but is not limited to, your name, your business name, street address, email address, telephone number, account information and data, other contact information, transaction information, sales information, prices, offers, bids, payment information, bank account information, and other information and data. You may also voluntarily provide other information or data to us from time to time. All information and data we collect during the above-described process is referred to in this Privacy Policy as "Use Information." We collect this information and data in order to allow you to access, use and acquire certain Software, Materials and Services and for other purposes. We may enter and store the Use Information in our database. We may also use it in order to contact you, request further information and data, supply information and data, or for other purposes.

Subscription Services Specific

If you use our Subscription Services we may access and use Client Data for the following purposes or under the following situations, and as set forth in your agreements with us:

  1. To set up the Subscription Services for you.
  2. To resolve technical support questions.
  3. To resolve problems or errors in the Subscription Services.
  4. To improve the Subscription Services.
  5. To send limited and necessary information to a third party who provides support services for us, such as sending and receiving emails.
  6. To contact you.
  7. To contact, solicit, and/or enter into agreements with others regarding their use of the Subscription Services and/or other services we provide.
  8. To send information to you.
  9. Suspected violation of agreements entered into by you.
  10. As required by law to resolve disputes and litigation.
  11. To determine amounts to charge for the use of the Subscription Services.
  12. To collect and store information about your visit to use the Subscription Services for internal purposes. This information may include the time and length of your visit, the pages you look at on our sites, and any site that you may have visited from which you linked to our site. We may also record the name of your Internet service provider and your IP address. We use this information to measure site activity and to develop ideas for improving our sites.

Mobile Applications

We create applications ("Mobile Applications") that our registered customers and their customers who may use the Subscription Services ("Users") may download to and run on their mobile devices ("Devices"). When you download or use Mobile Applications we may obtain information from or access data stored on User's Devices to provide services to the Mobile Applications and to improve the Mobile Applications. For example, our Mobile Application may access the geographical location at a specific time when an action is taken in the Mobile Application (most mobile apps allow you to turn off location services); access a camera on the Device to upload pictures to the Subscription Services; and access a unique identifier for your Device to, among other things, determine what type of Device and operating system you are using in order to assist in improving the Mobile Application. In addition to the unique identifier of your Device, we may access User's interactions with the Mobile Application, including dates and times when Users perform certain actions within the Mobile Applications, the number of installations of the Mobile Application, and which version is currently installed. We use information we collect for support, to develop new features, and to improve the overall quality of Company's products and services. We may also use the information to show you a history of your activity, to provide you with statistics about you or your use of the Subscription Services and Mobile Applications or to provide you with a better user experience. We may also use information obtained from your Device to assist in preparation for anticipated updates to the Mobile Application. Mobile Applications may transmit information to and from the Device in conjunction with the Subscription Services and reasons mentioned above. By installing our Mobile Applications on your Device you agree to the downloading and updating of the Mobile Applications on your Device. In order to use some functionality with the Mobile Applications, Users may need to download and use third party mobile applications. The privacy and terms of use for those third party mobile applications is governed by the applicable privacy policies and terms of use of such third parties. Terms of use related to our Mobile Applications may be found in the End User License Agreement and the agreement(s) entered into in order to use the Subscription Services.

Disclosure to Third Parties

Company does not accept any information or data provided through the Site on a confidential or proprietary basis except as required by law. We may use third parties to gather General Information, Email Information and/or Use Information. We may also employ directly as employees, or retain as independent contractors, agents or others, including third parties, who will access and use the General Information, Email Information and/or Use Information for purposes of administering our business activities, facilitating sales, providing or improving new or additional services and/or goods of our Company or others, providing support, arranging for payments, analyzing marketing matters, resolving differences, modifying the Site, or for other purposes. The third parties that perform services for or provide goods to us or you (e.g., credit card companies and processors, banks, merchant banks, internet service providers, etc.) may also have access to General Information, Email Information and/or Use Information. As you engage in business transactions or proposed business transactions through the Site, such as the listing, offer, sale or purchase of services and goods and other functions, we may disclose certain General Information, Email Information and/or Use Information to others relating to the transaction or proposed transaction and related matters as we deem necessary relating to the same. Should we buy or sell our business, assets or ownership interests, third parties may need to review Company information and data, including General Information, Email Information and Use Information. From time to time we may disclose General Information to third parties, but generally on an aggregate basis or as otherwise noted in this Privacy Policy. From time to time we may disclose Email Information to third parties in order to allow them to communicate with you, to respond to your inquiries, and for other purposes. From time to time we may disclose your Use Information to third parties for the foregoing or other purposes. By way of example, we may disclose your Use Information to third parties providing related or other services or goods, for payment purposes, or to facilitate sales. We may also hire third parties to provide services or goods on our behalf or for other purposes, at which time we may disclose General Information, Email Information and/or Use Information. If we do, we will generally provide those third parties the information and data that they need to perform or provide the services and goods or for other purposes as determined by us. Company does not generally sell or rent personally identifying information included in your Use Information to third parties except where it involves an entity or business related to or affiliated with Company, where related or other services or goods are to be provided by us or third parties as determined by us, where Company intends to sell part or all of its business, assets or ownership or as part of a sale, merger, acquisition or other transaction, or as otherwise contemplated in this Privacy Policy.

Google Analytics Advertising Features

Google is a Third Party we use to provide services for us. They require us to inform you that we use certain advertising features of their Google Analytics services. "Google Analytics Demographics and Interest Reporting" may be enabled for both the Subscription Service and the Site. This information may be used to use the General Information to diagnose problems with our servers, to administer the Site, to improve our Site, services and goods, and for other purposes such as generating or refining AdWord campaigns hosted on other sites not hosted or associated with the Company. Their analytic information is not associated with a single individual or their Personally Identifiable Information but may be associated with a Service Provider or Client ID. Google Analytics can be opted out through several methods including Google's browser add on (https://tools.google.com/dlpage/gaoptout/).

Legal

By using the Site, the Subscription Services, the Mobile Applications, or the Software, Materials and Services you consent to the collection, storage, transfer, and processing of your information and data including, but not limited to, the General Information, Email Information, Use Information and Client Data outside of your country of residence, including the United States.

Disclosure for Legal Reasons

Company may also disclose information and data that you provide through the Site, including but not limited to, General Information, Email Information and Use Information, when it believes, in its sole discretion, that the law requires such disclosures or if it has a good faith belief that such action is necessary or appropriate to comply with the law. Examples of such disclosure include, without limitation, to protect and defend the rights or property of Company, to protect the personal safety of the public or the users of the Site and/or the Software, Materials and Services, to comply with legal process, to enforce any terms or use agreement, other agreements, or this Privacy Policy, and to respond to claims.

Children

We have no way of distinguishing the age of individuals who access our Site. We do not intend to collect any personal information from children under the age of 18. If a parent or guardian of a child who has provided us with personal information would like the information deleted from our records, he or she should contact us at the email address listed at the bottom of this policy statement. We will then make reasonable efforts to delete the child's personal information from our files. We may also delete it in our own discretion. No part of our Site is structured to attract anyone under 13. No person under the age of 13 should disclose information on this Site. If we become aware that personally identifiable information regarding a child under the age of 13 has been collected at the Site, we will make reasonable efforts to delete it from our records or to otherwise respond as required by law.
